Definitions
1.1 "KCFI": Kinds Capital Financial Institute, acting under this name in the provision of
coaching, education and training services.
1.2 "Participant": Any person or entity who enters into an Agreement with KCFI, either by
signing a written agreement or by paying for a Program.
1.3 "Program": Any educational trajectory, coaching offer or training product (online or
offline) offered under the KCFI brand.
1.4 "Agreement": Any formal contract, order form, email confirmation or payment
transaction that activates participation in a Program.
1.5 "Materials": All documents, recordings, resources, tools, instructions and
communication shared by KCFI during a Program.
Acceptance and Legal Binding
2.1 These Terms and Conditions apply to all services and Programs offered by KCFI.
2.2 By making any form of payment to KCFI, the Participant explicitly agrees to these Terms
and Conditions, even if no separate signature has been provided.
2.3 These Terms have the same legal force as a signed Agreement and prevail in case of
inconsistencies between communication and expectations.
2.4 KCFI reserves the right to request formal signature of additional Agreements. Failure to
sign does not nullify the binding nature of these Terms once payment has been made or access
has been granted.
Program Structure and Delivery
3.1 The scope, structure, duration and access rights of each Program are as outlined in the
Program description or Agreement.
3.2 KCFI will make reasonable efforts to deliver Programs as described, including access to
calls, community platforms (e.g. Discord, WhatsApp), assignments and mentorship.
3.3 Participation is personal and non-transferable. Sharing logins, materials or internal content
with third parties is strictly prohibited.
3.4 If the Participant fails to participate actively (e.g. absence, inaction or lack of follow-
through), this does not entitle them to any refund, discount, or compensation.
Payments and Refunds
4.1 All Program fees are due as stated in the offer or Agreement. Payments are final, non-
refundable and binding unless explicitly stated otherwise in writing.4.2 In case of installment plans, each payment remains due regardless of usage or early withdrawal.
4.3 KCFI may suspend access to Programs or communication channels if payments are
delayed or reversed.
4.4 Any chargeback, dispute via payment provider, or reversal will trigger a penalty of €500,
plus legal or recovery costs and immediate exclusion from the Program.
Result Commitment and Conditional Guarantee
5.1 KCFI provides educational support and mentorship, not fixed results. All Programs are governed by a best-effort commitment.
5.2 Some Programs may include a conditional guarantee, which applies only if the Participant has demonstrably fulfilled all obligations, including but not limited to:
– full attendance in sessions,
– timely execution of assignments,
– communication via the correct channels,
– implementation of instructions,
– proper completion of the funding process (where applicable).
5.3 In such cases, the guarantee consists solely of additional support or extension, not refunds or financial compensation.
5.4 KCFI reserves the sole right to assess whether all requirements have been met. If not, the guarantee lapses automatically.
Intellectual Property and Confidentiality
6.1 All intellectual property shared in the Program remains owned by KCFI. No part may be
copied, reused or commercialized without explicit written consent.
6.2 The Participant agrees to keep all content, community information, sessions and materials
strictly confidential.
6.3 Violation of this clause will result in immediate removal from the Program and a
contractually enforceable penalty of €5,000 per breach, without prejudice to further legal
claims.
Conduct and Ethics
7.1 KCFI reserves the right to deny access to any Participant who displays unethical behavior,
dishonesty, fraud, or disrespect toward the team, mentors or other members.
7.2 In such cases, no refund or compensation is due.
Program Changes
8.1 KCFI may make structural, practical or content-related changes to Programs if necessary
to improve or maintain quality and continuity.
8.2 Such changes do not entitle the Participant to a refund, provided the core value of the
Program remains intact.
Limitation of Liability
9.1 KCFI shall never be held liable for trading losses, missed opportunities, emotional stress
or indirect damages.
9.2 The Participant is solely responsible for their own trading behavior, decisions and use of
the educational material.
9.3 Programs do not include financial advice, asset management or any regulated financial
activity under Dutch or foreign law.
Governing Law and Jurisdiction
10.1 These Terms are governed by Dutch law.
10.2 Any dispute shall be submitted exclusively to the competent court in the district of
Limburg, the Netherlands.
